Town Board tables special use permit request

The Town Board tabled approval of a special use permit for Daniel’s Deals Collision Shop, at 1685 Military Road, after hearing from nearby residents who complained of noise and smells coming from that area.

“During the day we smell chemicals coming from the shop, a chemical wash smell, and hear the radio all day until 11 p.m. at night,” said Briana Turner, who was at the meeting to protest the approval with her husband, Steven.

“We always hear banging noises,” added Steven Turner, noting that they live just two houses from the property. “We oppose having a shop put there.”

Although there is apparently some type of work going on at the site, Code Enforcement Officer Carl Heimiller said he is not clear on what that is but will be checking out the situation.

Following the complaints, the board raised a few questions to ask the business owners. They were not, however, present to talk about the project. Their absence raised questions about why sometimes people are not present to represent their projects.

While Heimiller is always present to discuss projects, board members said they want to see the people who are requesting the approvals. While they are asked to be at the board meetings, they do not always appear.

“If we have questions, and they’re not here to answer them, how can we get our answers?” asked Councilwoman Lisa Chimera.

Councilman Daniel Crangle added, “This is not the first time this has happened. The Planning Board needs to stress that they need to be here.”

Town Attorney John Flynn said during the meeting that the board should make it very simple: “If you don’t show up, you don’t get your approval.”

The board will reconsider the proposal for the automobile repair shop at its next meeting in a couple of weeks, provided the applicants show up at the meeting, board members said.

Also at the meeting, the board approved the sale of E-ZPass in the Town Clerk’s Office at the Municipal Building.

The Town Board will hold its next regular meeting at 7:30 p.m. Tuesday, April 21, in the council chambers at the Municipal Building, 2919 Delaware Ave.
